Jakarta, CNBC Indonesia – The land mafia case that happened to Nirina Zubir has entered a new phase. Now, the perpetrator of the forgery of Nirina's parents' house certificate, Riri Khasmita, who is in prison, has even filed a lawsuit against Nirina.
As reported by detik, Riri, who previously worked as a household member for Nirina's mother, admitted that she had been adopted by Nirina's late mother. Even Nirina Zubir felt sick the day Riri Khasmita said she had neglected her parents at the trial.
He claimed that he was asked directly to take care of the land documents belonging to Nirina Zubir's mother, who at that time was panicking because she couldn't find the house documents.
However, Nirina Zubir said that Riri influenced Nirina's mother, until she finally succeeded in carrying out the embezzlement action. As for two land certificates and four land and building certificates have a value of up to IDR 17 billion.
As reported by CNN in 2021, Riri carried out the action to change the name of the land certificate with the help of three Land Deed Officials (PPAT).
Of all these assets, Nirina said that two land certificates belonging to her mother were sold to third parties. Meanwhile, four building assets were pawned by the former household member to the bank so that the fresh funds from the pawning of the assets could be used as capital for the frozen food business.
“So actually the total land that was renamed was taken over by Mama's former household member. There were six of them. Then the four of them have been returned. The remaining two, these two have been split into four and they have all been sold,” said Nirina Zubir at the Brownis studio, Transmedia. , South Jakarta, yesterday.
“This is still being processed. In essence, these four which were mortgaged to the same bank have returned to us, to the heirs,” he continued.
Apart from the chaos of asset embezzlement, there are financial lessons related to the wealth distribution process that can be taken from this case, especially regarding the issue of splitting land certificates between heirs.
By dividing the land certificate, the heirs can use the asset freely or sell it at a later date.
But how to do this, and are there any costs involved? Here are the steps you can pay attention to.
Make an heir determination in court
If the land is to be inherited by more than one person, the transfer of land rights must be accompanied by a letter of proof as heir and a deed of distribution of inheritance. This has been regulated in Government Regulation Number 24 of 1997 concerning Land Registration (PP/24/1997), in Article 41 paragraph 4 which reads.
If the inheritance recipient is more than one person and at the time the transfer of rights is registered it is accompanied by a deed of distribution of inheritance containing information that the land rights or ownership rights to a particular apartment unit fall to one particular inheritance recipient, registration of the transfer of land rights or ownership rights to the unit The apartment is transferred to the recipient of the inheritance concerned based on a letter of proof of being the heir and a deed of distribution of the inheritance.
The proof of heirship can be in the form of a certificate of inheritance rights, or a letter determining heirs. To make a letter determining heirs, you can process it through an application to the court.
Apply for certificate splitting at the ATR/BPN office
For this, you can submit an application to the ATR/BPN office according to your domicile. Meanwhile, the documents that must be prepared for an application for splitting a land certificate based on Article 133 paragraph (1) of the Agrarian Ministerial Decree/BPN 3/1997 include:
-
certificate of title to the land concerned;
-
applicant's identity;
-
written consent of the holder of mortgage rights, if the land rights in question are encumbered with mortgage rights.
The application must also be accompanied by the interests and reasons for splitting the certificate.
Know the costs of breaking a land certificate
Understand that the larger the division and total land area, the greater the costs you will have to pay. The cost of splitting the land certificate is in addition to the registration fee.
The 2023 land certificate registration fee is IDR 50 thousand per application. The land measurement fee will be IDR 250 thousand. You also have to prepare a number of other additional costs such as:
