Jakarta, CNBC Indonesia – The Constitutional Court (MK) stated that there was no particular intention in distributing social assistance (bansos). This is part of the consideration of the decision on the 2024 Presidential and Vice Presidential Election Results Dispute which is being read by the Constitutional Court with petitioners Anies Baswedan-Muhaimin Iskandar.
“That there are suspicions regarding certain intentions in preparing the social security program, the court cannot know other intentions or intentions outside the aim of distributing social security or other intentions outside the aim of social security as conveyed by the ministers, especially the Minister of Finance,” said Constitutional Court Judge, Arsul Sani, in trial, Monday, (22/4/2024).
“The court also did not find convincing evidence that there were other intentions, apart from those confirmed by the court above,” he continued.
Arsul said that the distribution of social assistance is an implementation of the APBN Law and related laws and regulations. He said that if there is misuse of the budget related to the distribution of social assistance, this should be handled by law enforcement.
“Thus, if there is misuse of the budget related to the distribution of social security funds, it is the domain of law enforcement to follow up,” he said.
Arsul said regarding the time period for distributing social assistance, he said that determining the distribution is very related to the objectives of social assistance. If it is an anticipatory measure, it is carried out before a disaster occurs. If it is as mitigation, it is carried out after the disaster occurs.
“Therefore, social security programs are commonly used before and after disasters,” he said.
